Strava Competition Terms & Conditions

VITA COCO COMPETITION TERMS AND CONDITIONS (JANUARY 2024)

No payment is necessary to participate in this competition. Your attention is drawn to clause 8 (limitation of liability) of these terms and conditions.

1. The Promoter

The promoter is: ALL MARKET EUROPE LIMITED t/a Vita Coco, a company incorporated and registered in England and Wales with company number 07088143 and whose registered office is at 2nd Floor 55 Charterhouse Street, London, EC1M 6HA (the “Promoter”).

2. The competition

2.1 The title of the competition is “Vita Coco’s Thirst Place Challenge with Zharnel Hughes”.

2.2 The Promoter is holding a competition on the Strava platform, available at www.strava.com and via the “Strava: Run, Bike, Hike” app available on the Google Play Store and the Apple App Store (the “Strava Platform”) for entrants to complete a running challenge and be in with a chance of winning free entry to the London Winter Run 2024 or a 7-day trip to Jamaica with a training session with Zharnel Hughes, subject to the terms and conditions set out below.

2.3 By entering into this competition, you confirm that you have read and understood these terms and conditions (“Terms”) and agree to be bound by them.

3. Eligibility

3.1 The competition is only open to all residents in the UK who are aged 18 years or over at the time of entry, except:

(a) employees, directors or subcontractors of the Promoter or its holding or subsidiary companies;

(b) employees or directors of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

3.2 In entering the competition, you warrant and represent that you are eligible to do so, eligible to claim any prize you may win and that you are entering as an individual in your

personal capacity only. The Promoter may require you to provide proof that you are eligible to enter the competition.

3.3 The Promoter shall not accept competition entries that are:

(a) automatically generated by computer or created by artificial intelligence;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(d) incomplete.

3.4 There is a limit of one entry per person. Entries on behalf of another person shall not be accepted and joint submissions are not allowed.

3.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4. How to enter

4.1 The competition shall run from 00:01 on 22 January 2024 (the "Opening Date") to 23:59 on 11 February 2024 (the "Closing Date") inclusive (the “Competition Period”).

4.2 All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

4.3 To enter the competition, you must complete the following:

(a) if not already registered as a user of the Strava Platform, complete all registration instructions on either the Strava website or via the mobile app, which includes providing your name and email address and any other information as required;

(b) click the “Join Challenge” button on the competition page, available here: https://strava.app.link/vita-coco-thirst-place-Zharnel; (c) subject to clause 4.4, successfully log a cumulative total of 9.83km as a “run” (whether indoor or outdoor and including “virtual runs”) on the Strava Platform during the period beginning 00:01 on 22 January 2024 and ending at 23:59 on 28 January 2024 (the “Run Challenge”); (d) in order to be eligible to win the Jamaica Trip (as defined at 5.1(a)(ii) below), you must set the visibility of all your logged runs which you intend to count towards the Run Challenge as “public” on the Strava Platform; and

(e) complete the entry form on the Promoter’s website , the link for which will be supplied via the Strava Platform and indicate your wish to be entered into the

competition for the Prizes before the end of the Competition Period (incomplete entry forms will not be sufficient to be entered into the competition). A failure to complete any of the steps set out at 4.3(a) to 4.3(e) above shall mean you will not be entered into the prize draw for the Prizes and not be eligible to receive a Voucher Code as described at clause 7.1 below.

4.4 Manual entries of “runs” and any “runs” not shared publicly within the Strava Platform shall not count towards to the Run Challenge. All runs completed and/or logged before 00:01 on 22 January 2024 or after 23:59 on 28 January 2024 deadline shall also not count towards the Run Challenge.

4.5 No purchase is necessary and there is no charge to register for use of Strava or to enter the competition.

4.6 The Promoter shall not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

4.7 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

5. The Prizes

5.1 All entrants who meet the eligibility criteria and have entered the competition in accordance with clauses 3.1 and 4.3 above shall:

(a) if selected in the entry form, be entered into a prize draw for the following prizes:

(i) one of five free entries to the London Winter Run 2024 taking place on 25 February 2024 (the “LWR Free Entry”); and

(ii) a 7-day trip to Jamaica and a 2-hour training session with Zharnel Hughes as set out in clause 5.3 below (one (1) winner) (the “Jamaica Trip”),

together the “Prizes”.

5.2 The LWR Free Entry shall include a ticket to the event only and shall not cover the costs of any travel, food or accommodation whilst attending the event, all of which shall be borne solely by each winner.

5.3 The Jamaica Trip consists of travel by economy class flight to Kingston, Jamaica and hotel accommodation at an “all inclusive” resort (which shall include food and beverages whilst at the resort, subject to the resort’s own policy) for seven (7) nights for up to two people, and a two-hour running training session with Zharnel Hughes organised by the Promoter,

including the cost of transfers to and from airports and the training session. The Jamaica Trip must take place and be completed before 31 December 2024 (exclusive of that date), subject always to Zharnel Hughes’ availability (including but not limited to any limitation arising from competition schedules and training regimes). The exact dates of the Jamaica Trip must be agreed between the winner and the Promotor, both parties acting reasonably. The prize does not include travel insurance, spending money, tax, costs for food and beverage outside of the accommodation, personal expenses, sundries or any activities at the accommodation for which there is ordinarily an additional charge. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.

5.4 The winner shall be responsible for ensuring that they and any person travelling with them are available to travel and hold valid passports, any necessary visas and travel documents for the trip in question on the travel dates specified. Once the dates for the Jamaica Trip have been notified and confirmed in writing with the winner, they cannot be changed.

5.5 Prizes, in particular the flights and accommodation which form part of the Jamaica Trip, are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal value.

5.6 In the event that Zharnel Hughes becomes unavailable for any reason, including but not limited to any injury, personal crises or unavoidable personal commitments, the Promotor may cancel the training session and such notice may be on short notice. In such circumstances, the winner shall have no right to a substitute prize.

5.7 The Prizes are personal to each winner and are not negotiable or transferable.

6. Selection Process

6.1 Within five (5) days following the end of the Competition Period, the Promoter shall select, by means of a random draw, five (5) entrants who shall each win one LWR Free Entry.

6.2 Within five (5) days following the end of the Competition Period, the Promoter shall select, by means of a random draw, one (1) entrant who will win the Jamaica Trip.

6.3 The Promoter reserves the right to review all activities undertaken by entrants and recorded on the Strava Platform to check for any evidence of cheating, foul play or breaches of any of the rules or these Terms and verify any winning entries. Entrants acknowledge and accept that such details and performance data shall be shared with the Promotor by Strava for the purposes of such verification.

7. Winners

7.1 Upon successfully completing the Run Challenge and submitting the entry form (set out in clause 4.3(e)), entrants shall be entitled to receive be entitled to receive one (1) voucher code for a 20% off discount on one (1) order placed on the “vita coco” UK online store located at www.vitacoco.co.uk (the “Voucher Code”). The Promoter shall email entrants details of how to claim the Voucher Code.

7.2 Each winner of a LWR Free Entry shall be contacted by the Promoter via email using the contact details provided to the Promoter and each winner must respond to that email confirming their availability to attend the London Winter Run 2024 and acceptance of the same within 24 hours of such email being sent from the Promoter. Any failure to confirm availability within 24 hours may result in the LWR Free Entry being withdrawn without further notice and the Promotor shall select another winner at random. The same rules relating to confirming availability shall apply to any replacement winners selected.

7.3 The winner of the Jamaica Trip shall be contacted via email using the contact details provided to the Promoter and the winner must respond to such email confirming their availability and acceptance of the prize within 7days of such email being sent from the Promoter. The winner shall also provide to the Promoter any other documentation or information reasonably requested by the Promoter for the purpose of administering the Jamaica Trip. Failure to confirm availability within the timescale above or provide information requested by the Promoter within a reasonable time may result in the Jamaica Trip prize being withdrawn without further notice and the Promoter shall be entitled to select another winner in accordance with clause 6.2. The same rules relating to confirming availability and provision of information shall apply to any replacement winners selected.

7.4 Decisions made by the Promoter shall be final and no correspondence or discussion shall be entered into regarding such decisions.

7.5 The Promoter shall either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter shall publish the name and Strava Platform Username of all the Prize winners (both winners of the LWR Free Entries and the winner of the Jamaica Trip) on 11th March 2024 (the “Announcement Date”) at https://vitacoco.co.uk/pages/strava-983-thirst-place-challenge.

7.6 If you object to either your name or your Strava Username being published or made available, please contact the Promoter via email at premea@vitacoco.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority if so requested.

7.7 The Promoter does not accept any responsibility if you are not able to take up any of the prizes referred to herein.

7.8 All entrants shall be deemed to grant the Promotor a non-exclusive, royalty-free, perpetual licence to use all materials and intellectual property submitted by that entrant on the Strava App or directly to the Promotor (including but not limited to details of all Run Challenge runs, any photos relating to the Run Challenge runs, the contents of all entry forms, any related correspondence or communications and, in respect of the winner of the Jamaica Trip and all photos and materials relating to the Jamaica Trip).

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors shall not in any circumstances be responsible or liable to compensate any winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up any of the Prizes (including but not limited to related to travel, accommodation and participation in the Jamaica Trip and participation in the London Winter Run 2024), except where it is it the direct result of the proven negligent act or omission (where there was a duty to act) of the Promoter or its employees. Your statutory rights are not affected. 8.2 Subject to clause 8.1, the Promoter is not liable if an entrant injures themselves while performing actions with regard to this competition. By entering into the competition, you represent that you do not have any condition and are not affected by any circumstances that would prevent you from safely participating in the competition or claiming any of the Prizes or would pose a present risk to others in your doing so. You also agree that you are not otherwise prohibited from participating in the Promotion for any reason.

8.3 In no event shall the Promoter be responsible or liable for any failure or delay in the performance of its obligations under these Terms arising out of or caused by, directly or indirectly, circumstances or forces beyond its reasonable control, including but not limited to strikes, work stoppages, accidents, or acts of god, and interruptions, loss or malfunctions of utilities, communications or computer (software or hardware) services, when these circumstances constitute a force majeure event or equivalent as defined under applicable local law.

9. Data protection and publicity

9.1 The Promoter shall only process your personal information as set out in the privacy policy at https://vitacoco.co.uk/pages/privacy-policy. See also clauses 7.5 and 7.6, with regard to the announcement of winners. 9.2 For the avoidance of doubt, this clause 9 relates specifically to personal data provided directly to the Promoter by you and specifically excludes data you may provide via the Strava Platform, which shall be governed by Strava’s Privacy Policy and Terms of Use. If

you withdraw your consent from either the Promotor or Strava you agree that the Promoter may retain your data in an anonymised form.

10. General

10.1 If there is any reason to believe that there has been a breach of these Terms, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

10.3 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
